{"id":90586,"date":"2026-08-03T09:43:40","date_gmt":"2026-08-03T09:43:40","guid":{"rendered":"https:\/\/bitcoinwisdom.com\/?p=90586"},"modified":"2026-08-03T09:43:40","modified_gmt":"2026-08-03T09:43:40","slug":"binance-continues-to-seek-dismissal-of-the-cft","status":"publish","type":"post","link":"https:\/\/bitcoinwisdom.com\/fr\/binance-continues-to-seek-dismissal-of-the-cft\/","title":{"rendered":"Binance continue de demander le rejet de la poursuite CFTC"},"content":{"rendered":"\n<ul class=\"wp-block-list\">\n<li><strong>Binance asked the court to dismiss the charges with prejudice.<\/strong><\/li>\n\n\n\n<li><strong>The CFTC charged Binance with providing illegal services to U.S. customers.<\/strong><\/li>\n\n\n\n<li><strong>Binance argued that the CFTC had overstepped its jurisdiction with its lawsuit.<\/strong><\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<p>Attorneys representing cryptocurrency exchange <a class=\"wpil_keyword_link\" href=\"https:\/\/bitcoinwisdom.com\/binance-review\/\" title=\"Binance\" data-wpil-keyword-link=\"linked\">Binance<\/a> and its CEO, Changpeng &#8220;CZ&#8221; Zhao, have submitted statements in favor of a move to dismiss the U.S. Commodities Futures Trading Commission (CFTC) lawsuit against both parties.<\/p>\n\n\n\n<p>The lawyers claimed that if the court upholds the CFTC&#8217;s claims, it &#8220;would allow it to regulate any activity in cryptocurrency [&#8230;] related to a derivatives product&#8221; globally. Binance further said the CFTC is attempting to regulate the global market by pursuing legal action against a company that has attempted to steer clear of U.S. business. <\/p>\n\n\n\n<p>The exchange\u2019s lawyers wrote in their filing:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>The CFTC relies on new and broad arguments that would allow it to regulate any activity in cryptocurrency (or other assets) related to a derivative product anywhere on the globe. U.S. law governs domestically but does not control the world. Congress did not make the CFTC the world\u2019s derivatives police.<\/p>\n<\/blockquote>\n\n\n\n<p>The CFTC accused Binance in March of intentionally providing unregistered cryptocurrency derivatives. In a follow-up filing dated September 22, the agency stated that Zhao had &#8220;deliberately targeted&#8221; the US market. Binance&#8217;s lawyers urged the court to dismiss the CFTC&#8217;s complaint without prejudice. <\/p>\n\n\n\n<p>This is not the first time Binance has sought a dismissal of the case. In July, the crypto exchange <a href=\"https:\/\/bitcoinwisdom.com\/binance-and-its-ceo-seek-to-get-the-cftc-lawsuit-dismissed\/\" target=\"_blank\" aria-label=\"sought (opens in a new tab)\" rel=\"noreferrer noopener\" class=\"ek-link\">sought<\/a> to dismiss the charges, claiming the CFTC&#8217;s lawsuit was \u201cunexpected and disappointing.\u201d Binance also faces serious charges from the US Securities and Exchange Commission (SEC).
