It is important to note that a panel of three judges made the decision, calling the lawyers\u2019 arguments &#8220;unpersuasive.\u201d<\/p>\n\n\n\n<p>The panel of three judges from the United States Court of Appeals for the Second Circuit denied the FTX founder\u2019s attempts for an early release from prison as per a September 21 order, which the legal team argued was largely due to First Amendment issues.&nbsp;<\/p>\n\n\n\n<p>Circuit Judges John Walker Jr., Denny Chin, and William Nardini ruled that Judge Lewis Kaplan, the judge presiding over SBF\u2019s case, had \u201ccorrectly determined\u201d that Bankman-Fried\u2019s speech amounted to witness tampering.<\/p>\n\n\n\n<p>The order added that \u201crecord shows that the district court thoroughly considered all of the relevant factors, including [SBF\u2019s] course of conduct over time that had required the district court to repeatedly tighten the conditions of release,\u201d while adding:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cIt also shows that the district court contemplated a less restrictive alternative offered by [SBF] \u2014an order limiting his communications with the press\u2014but reasonably concluded this was not \u2018a workable solution longer term.\u2019\u201d<\/p>\n<\/blockquote>\n\n\n\n<p>As reported earlier by BitcoinWisdom, the FTX crypto exchange is currently undergoing major changes, and the creditors seek to restart the firm. The exchange recently claimed that SBF\u2019s parents, Joe Bankman and Barbara Fried, <a href=\"https:\/\/bitcoinwisdom.com\/ftx-claims-bankman-frieds-parents-played-a-par\/\">helped cover up some of their son\u2019s fraudulent schemes<\/a> in a lawsuit.<\/p>\n\n\n\n<p>Joe and Barbara \u201cexploited their access and influence within the FTX enterprise to enrich themselves, directly and indirectly,\u201d the lawsuit filed by the crypto exchange under new management stated.<\/p>\n\n\n\n<p>On the other hand, the three-judge panel has decided to decline SBF\u2019s appeal to come out of jail, and the order noted that:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>&#8220;[T]he district court did not err in concluding that [SBF] had failed to rebut the presumption in favor of detention.
